IN FOCUS: Fair Entitlements Guarantee

FEG is a legislative safety scheme of last resort assistance available for eligible employees.  The scheme provides financial assistance to eligible employees who have lost their jobs due to the liquidation or bankruptcy of their employer and who are owed employee entitlements which are not able to be paid by their employer or from another scheme.


  • Employment must have ended due to the employer’s insolvency.
  • Employer entered insolvency after 5 December 2012.
  • Employment ended within 6 months before or after an insolvency practitioner’s appointment.
  • Employee must be an Australian citizen, permanent visa holder, or special category visa holder.


  • Contractors, subcontractors, and excluded employees per the Corporations Act 2001.
  • Employees who converted from contractor status within 6 months before insolvency.
  • Employees covered by the Ansett Group Employee scheme.

Assistance Provided:

  • Up to 13 weeks of unpaid wages.
  • Annual leave, long service leave.
  • Payment in lieu of notice (up to 5 weeks).
  • Redundancy pay (up to 4 weeks per year of service).

Assessment Process:

  • The Department of Employment and Workplace Relations evaluates claims, verifies outstanding entitlements with insolvency practitioners, and resolves discrepancies before making payments directly to claimants.

FEG Recovery Program:

  • Funds recovery actions for amounts advanced under FEG, including legal proceedings against third parties and investigations into voidable transactions, insolvent trading, and failure to pay entitlements.
  • From 1 July 2024, the program will also target recovery of unpaid superannuation entitlements.

Maximum Weekly Wage:

Employee entitlements are capped by a maximum weekly wage, with different caps applied each year. Entitlements are calculated based on this cap, and any excess must be claimed from the insolvent estate.
